說明：關於債務人行使同時履行抗辯權後，有無溯及消滅其遲延責任，最高法院阮富枝法官自學理上探討同時履行抗辯權之意義與設立之本旨，由公平正義之角度，反推思考債務人之遲延責任究應採取溯及或不溯及消滅，較合於公平理念。

一、存在效果（王澤鑑、鄭玉波、史尚寬）

說明：抗辯權之存在本身即足排除遲延責任

理由尚可分為：

㈠抗辯權排除債務之屆期

㈡因有抗辯權之存在，給付遲延係非可歸責於債務人之事由

二、行使效果說（最高法院）

說明：抗辯權須經行使始能排除遲延責任

抗辯權經行使後尚可分為：

㈠抗辯權之行使，溯及地排除已發生之遲延效果遲延利息溯及消滅

㈡於不公平之情形已發生之遲延責任，不因抗辯權之行使而受影響

受領遲延惟若一方因他方陷入受領遲延而無須負給付遲延責任，他方未曾提出給付，卻因嗣後行使同時履行抗辯權而溯及不負給付遲延責任，對曾提出給付之一方並不公平。

採取不溯及消滅說

〈〉甲有市價十萬元的古畫，以十二萬之價格讓售給乙，乙之後以該件古畫贈與丙並移轉之。丙又將該畫與丁價值十四萬玩之麥森瓷偶互易，並交付之。

　　若甲為受監護宣告人，乙丙丁皆善意不知。問：

1.　個別契約之效力如何？

2.　甲得向乙主張何權利？

3.　甲得向丙主張何權利？

4.　若甲為受輔助宣告者，上述問題知答案是否也別？

〈〉甲於三月一日向乙訂購音樂CD「三月天杜鵑花歷年精選」一組，兩人約定於三月八日由出賣人乙送至甲的家中，送貨當天，乙派遣其員工丙送貨，若丙於半途中因過失導致該音樂CD破碎，則甲、乙、丙三人間應如何主張權利？

2017/03/21

〈〉甲將所有之一層公寓出租給乙，租期六年，每月租金四萬元，並由乙交付十萬元押金給甲。甲所擁有之公寓在某次地震中出現陽台磁磚剝落與龜裂現象，因乙個人未利用陽台因此置之不理，某日路人丙走過，被剝落的磁磚打到，頭破血流，問甲與丙應如何主張權利？

　　若租約期限屆滿前，甲將該層公寓贈與給丁，則丁是否得請求乙遷離？押金應向誰請求返還？

　　押租金要物契約從契約

〈〉甲出售A土地給乙，約定價金兩千萬，並由甲的父親丙提供B土地作為擔保，設定抵押權給乙，乙則先支付定金兩百萬。甲與乙締約後不久，乙以A地作為標的再與丁締結買賣契約，並出示甲與乙之契約書，乙丁約定價金兩千五百萬，甲亦知悉此事。

1.　若甲將A地又出售給庚，並移轉A地給庚，乙因此解除契約，問：乙得如何主張權利？

2.　若甲與乙約定於給付不能時應支付違約金三百萬，是否影響損害賠償之請求？
